Legal basis like in constitution or civil code to answer why a 108 year old prisoner in India is freed?

pertaining to that question. what Legal issue might arise when a person in the prisoner, despite of being old. the government jail authorities who were in it find difficult to provide him the required medical treatment. isn't it unconstitutional if you let free a person sentence to death imprisonment and having a crime of murder?
