If a murderer is mentally unstable, will he be allowed to skip death penalty?

Just like, if a murderer kills people who are exploiters and things like that and is also mentally unstable due to a horrible childhood (like his parents got killed by accident in a police raid when it wasn't their fault), will he be allowed to skip death penalty and only have 10 years of imprisonment?
